Procedures & Milstones : Ill-Gotten gains – Syria

27 July 2011: a complaint was made with Transparency International France (TI France) to the Public Prosecutor in Paris concerning the movable and immovable property held in France by this Syrian national involving around twenty people.

Proceedings related to this complaint were discontinued.

13 September 2013: A new complaint was lodged with the Public Prosecutor in Paris by Sherpa and TI France against Rifaat Al-Assad.

30 September 2013: A preliminary investigation was opened by the Public Prosecutor in Paris.

6 February 2014: A complaint with civil party petition made by Sherpa against Rifaat Al-Assad with the investigating judge.

Note: When a complaint is lodged with the Public Prosecutor, he has 3 months in which to make a judgement. If at the end of the 3 month period the Prosecutor has not made a decision or decides not to continue proceedings, the plaintiff can overcome the Prosecutor’s inertia by making a complaint with civil party petition, allowing a request to the investigating judge to initiate criminal proceedings and be associated with the conduct of investigations.

18 February 2014: Decision by investigating judge on payment for the civil party petition.
